Terms of Use

Rethink Open House (“ROH”) is an online technology and real estate marketing platform owned and operated by Rethink Worldwide LLC.

By creating an account, purchasing a membership or credits, submitting an application, uploading content, creating or publishing a listing, or otherwise using Rethink Open House, you agree to these Terms of Use.

1. Rethink Open House Platform

Rethink Open House provides technology, marketing, property-presentation, professional-profile, media-management, and communication tools for real estate professionals, media professionals, buyers, sellers, and other users.

ROH is designed to complement existing real estate marketing and MLS systems by allowing professionals to present properties, professional information, photos, videos, sold-property information, and other marketing content.

Rethink Open House does not itself represent a buyer or seller merely because that person uses the ROH website, contacts a professional through ROH, views a property, or becomes an ROH member.

2. Relationship to Rethink Worldwide LLC

Rethink Worldwide LLC is a licensed real estate brokerage in the State of Florida.

However, use of the Rethink Open House platform does not, by itself, create a brokerage, agency, fiduciary, representation, listing, buyer-representation, or other real estate brokerage relationship between a user and Rethink Worldwide LLC.

ROH memberships, listing credits, sold-listing credits, media credits, and other platform fees are charges for access to and use of ROH technology and marketing services. They are not real estate commissions or referral fees.

If Rethink Worldwide LLC separately provides real estate brokerage services to a particular client or customer, those services and that relationship are separate from ordinary use of the ROH platform and may be governed by separate agreements, disclosures, or legal requirements.

3. Geographic Availability

ROH currently supports professional memberships and property listings in the United States, including Puerto Rico and other U.S. territories and possessions supported by the platform.

Availability of ROH services, markets, professional memberships, and property listings may vary by state, territory, possession, or other geographic area.

Members may not misrepresent their location, professional market, licensing information, or a property’s location in order to use ROH for activity outside the geographic areas currently supported by the platform.

Members are responsible for complying with any licensing, advertising, professional, tax, and other legal requirements applicable in the jurisdiction where they conduct business or market property.

ROH may expand into additional countries, territories, or geographic areas in the future under different terms, tax requirements, policies, or eligibility requirements.

4. Professional Memberships

Agent members represent that the professional and licensing information they provide is accurate and that any real estate license represented through ROH is valid as required by applicable law.

Media Professional members represent that their professional, business, portfolio, service-area, and other information is accurate.

Members are responsible for keeping their account and professional-profile information current.

ROH may request additional information or verification and may suspend, restrict, or remove an account if information appears inaccurate, misleading, fraudulent, expired, unauthorized, or inconsistent with these Terms.

Membership in ROH does not constitute endorsement, certification, recommendation, employment, partnership, or agency by Rethink Worldwide LLC.

5. Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You may not impersonate another person, create an account using materially false information, improperly share account access, or attempt to gain unauthorized access to another account or to ROH systems.

You should notify ROH promptly if you believe your account has been compromised.

6. Listings and Property Information

Members are responsible for the accuracy and legality of property information they submit to ROH.

You may only create, edit, publish, contribute to, or submit a property listing when you have the authority or permission necessary to do so.

Members remain responsible for compliance with applicable:

  • real estate licensing requirements;
  • advertising regulations;
  • fair housing laws;
  • MLS rules and policies;
  • brokerage requirements;
  • intellectual-property laws;
  • privacy requirements; and
  • other laws, regulations, contracts, and professional obligations applicable to their activities.

ROH does not independently verify every property fact, professional representation, photograph, video, statement, or other item submitted by members.

ROH may remove, restrict, correct, temporarily disable, or require reconfirmation of listings that appear inaccurate, outdated, unauthorized, unlawful, misleading, outside ROH’s supported geographic areas, or inconsistent with ROH policies.

7. Photos, Videos, and Other Content

You retain ownership of content that you own and upload to ROH.

By uploading or submitting content, you represent that you have the rights and permissions necessary for ROH to receive, store, process, display, distribute, and deliver that content as required to provide the service.

You grant Rethink Worldwide LLC a non-exclusive license to host, store, copy, resize, optimize, cache, display, transmit, distribute, and deliver submitted content as reasonably necessary to operate Rethink Open House, display property and professional pages, provide authorized media delivery, and maintain the platform.

Media Professionals are responsible for ensuring they have appropriate authorization to upload and deliver media belonging to their clients or other rights holders.

You may not upload content that infringes intellectual-property rights, violates privacy rights, contains unlawful material, or that you are not authorized to use.

8. Professional Connections and Leads

ROH may allow consumers, Seller Agents, Buyer Agents, Media Professionals, and other users to discover and contact one another directly.

ROH does not guarantee the qualifications, conduct, availability, performance, licensing status, suitability, or results of another user.

Users are responsible for deciding whether to contact, hire, represent, work with, or enter into an agreement with another person or business found through ROH.

ROH does not sell a user’s inquiry as a lead merely because the user contacts a professional through the platform, and ROH does not charge a real estate referral fee merely because users connect through ROH.

Any brokerage, representation, referral, media-services, or other professional relationship subsequently established between users is separate from ordinary ROH platform membership.

9. Membership Fees and Credits

Membership fees and listing, sold-listing, and media credits are priced as displayed at the time of purchase.

Unless expressly stated otherwise during checkout, current ROH memberships and credits are one-time purchases and are not automatically renewing subscriptions.

Credits are rights to use designated ROH platform features. Credits are not cash, deposits, securities, stored-value accounts, or transferable currency and have no cash redemption value.

Purchases are subject to the ROH Refund Policy, which is incorporated into these Terms.

Applicable taxes may be added, collected, or remitted where required by law.

Payments may be processed by third-party payment providers such as Stripe and may also be subject to their applicable terms and policies.

10. No Guaranteed Results

ROH does not guarantee:

  • that a property will sell;
  • that a buyer will purchase a property;
  • that a professional will obtain clients, listings, assignments, leads, or referrals;
  • any particular number of inquiries, views, contacts, or visitors;
  • any particular level of search-engine placement or visibility;
  • any amount of revenue or business activity; or
  • any particular response from another user.

ROH provides technology and marketing tools. Results depend on numerous factors outside the control of Rethink Worldwide LLC.

11. No Real Estate Advice Through Platform Use

General information presented on ROH is not a substitute for legal, tax, financial, lending, appraisal, inspection, title, or other professional advice.

Property information and professional content may be supplied by third parties and should be independently evaluated where appropriate.

Use of ROH alone does not constitute personalized real estate brokerage advice from Rethink Worldwide LLC.

12. Prohibited Conduct

You may not use ROH to:

  • publish false, deceptive, fraudulent, discriminatory, or unlawful content;
  • advertise property you are not authorized to market;
  • misrepresent professional credentials, licensing, geographic eligibility, or property location;
  • list properties outside geographic areas currently supported by ROH;
  • circumvent geographic restrictions by selecting a false market, address, location, or jurisdiction;
  • infringe copyrights, trademarks, privacy rights, or other rights;
  • distribute malware, spam, or malicious content;
  • scrape, harvest, overload, attack, disrupt, or interfere with ROH systems;
  • improperly use another member’s information, media, or identity;
  • circumvent membership, credit, payment, approval, security, or access controls; or
  • use ROH for unlawful or fraudulent purposes.

13. Suspension and Removal

ROH may suspend or terminate accounts, remove listings or content, restrict features, reverse access privileges, or deny access when reasonably necessary to protect ROH, its users, third parties, payment systems, or the integrity of the platform.

Serious or repeated violations may result in permanent removal.

Suspension or termination resulting from a violation of these Terms does not automatically create a right to a refund.

14. Third-Party Services

ROH may use third-party services including payment processors, hosting providers, media-storage providers, mapping services, video platforms, email providers, analytics providers, and other technology vendors.

Rethink Worldwide LLC is not responsible for outages, failures, policy changes, interruptions, or actions of third-party services outside its reasonable control.

Links, embeds, or integrations involving third parties do not necessarily constitute endorsement of those third parties.

15. Service Availability and Changes

ROH may update, improve, modify, add, discontinue, restrict, or replace features as the platform evolves.

ROH does not guarantee uninterrupted or error-free service.

Maintenance, security issues, provider outages, technical problems, internet failures, natural events, governmental action, or other circumstances outside ROH’s reasonable control may temporarily affect availability.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Rethink Open House and its services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

Rethink Worldwide LLC does not warrant that information supplied by members, users, professionals, property owners, MLS systems, media providers, or other third parties is accurate, complete, current, or suitable for a particular purpose.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Rethink Worldwide LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of ROH, loss of data, lost business opportunities, lost profits, transactions between users, professional relationships between users, or reliance on content supplied by users or third parties.

To the fullest extent permitted by law, the aggregate liability of Rethink Worldwide LLC arising from a user’s use of ROH will not exceed the amount that user paid directly to ROH during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, costs, and expenses resulting from your unlawful use of ROH, your violation of these Terms, content you submit without proper authority, inaccurate professional or property representations you make, or your violation of another person’s rights.

19. Privacy

Use of ROH is also subject to the published ROH Privacy Policy.

20. Changes to These Terms

Rethink Worldwide LLC may update these Terms as ROH, its services, its business model, supported geographic areas, or applicable laws change.

The Effective Date at the top of this page identifies the current version.

Material changes may require members to review or accept updated Terms before continuing to use certain services.

21. Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles, except where another law must apply regardless of this provision.
